2. User Accounts

2.1 Account Creation

To use our services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 Account Types

Our Platform offers two types of accounts:

• Rider Account: Allows users to request and pay for transportation services.
• Driver Account: Allows users to offer transportation services through our Platform, subject to additional verification and eligibility requirements.

2.3 Account Security

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to maintain the security of your account.

3. Platform Rules and Conduct

3.1 General Rules

When using our Platform, you agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Use our Platform for any illegal or unauthorized purpose
• Interfere with or disrupt the operation of our Platform
• Attempt to gain unauthorized access to our systems or user accounts
• Harass, threaten, or intimidate other users
• Post false, misleading, or deceptive content

3.2 Rider Conduct

As a rider, you agree to:

• Treat drivers with respect and courtesy
• Be at the pickup location when the driver arrives
• Not bring illegal substances or weapons in the vehicle
• Not damage or vandalize the driver's vehicle
• Comply with all safety instructions provided by the driver

3.3 Driver Conduct

As a driver, you agree to:

• Maintain a valid driver's license and all required permits
• Keep your vehicle clean, safe, and in good operating condition
• Follow all traffic laws and safety regulations
• Treat riders with respect and courtesy
• Follow the route suggested by the Platform unless the rider requests otherwise
• Not discriminate against riders based on race, religion, nationality, disability, sexual orientation, gender, or any other protected characteristic

4. Payment Terms

4.1 Pricing

Ride prices are calculated based on distance, time, demand, and other factors. Prices may vary and are subject to change. The Platform will display the estimated price before you confirm a ride request.

4.2 Payment Methods

We accept various payment methods as indicated in the app. By providing a payment method, you represent that you are authorized to use the payment method and authorize us to charge the full amount of the ride, including applicable fees, taxes, and gratuities.

4.3 Driver Payments

Drivers will receive payment for completed rides according to our payment schedule, minus applicable service fees. Detailed payment information is available in the Driver Agreement.

5. Cancellation Policy

Riders may cancel a ride request, but cancellation fees may apply depending on the timing of the cancellation and other factors. Drivers may also cancel ride requests, but excessive cancellations may result in penalties or account deactivation.

Specific cancellation fees and policies are displayed in the app and may be updated from time to time.

6. Intellectual Property

All content, features, and functionality of our Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Efoyy Transport Technology Solutions (ETTS) or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform without our prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law, Efoyy Transport Technology Solutions (ETTS) and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you have paid to us for the use of our services during the twelve (12) months preceding the event giving rise to the liability.

8. Indemnification

You agree to defend, indemnify, and hold harmless Efoyy Transport Technology Solutions (ETTS), its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.

9. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of our Platform shall first be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association or another mutually agreed-upon arbitration service.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Any arbitration shall be conducted on an individual basis.

10. Termination

We reserve the right to suspend or terminate your account and access to our Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Modifications to Terms

We may revise these Terms from time to time at our sole discretion. All changes are effective immediately when posted and apply to all access to and use of the Platform thereafter.

Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

12. Governing Law

These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles. Your use of the Platform may also be subject to other local, state, national, or international laws.
